Terms of service

These terms are the agreement between you and SIMINO LABTEST PRIVATE LIMITED for your use of Yesroll. By creating an account, joining early access or otherwise using the service, you accept them. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.

1. Who you are contracting with

Yesroll is operated by SIMINO LABTEST PRIVATE LIMITED, a company incorporated in India. In these terms “we”, “us” and “Yesroll” mean that company, and “you” means the person or organisation using the service.

Simino Technology LLC, an affiliate in the United States, is named here for transparency. It is not a party to this agreement and does not supply the service.

2. What Yesroll is

Yesroll is a hosted application for organising people. It combines four jobs that are normally sold separately — invitations with RSVP tracking, bookable time slots, signup sheets, and questions — around one shared list of respondents, which we call aroll.

Some terms used throughout:

  • Organiser — a person with access to your account who creates or manages rolls.
  • Guest — a person you invite, who responds to one of your rolls.
  • Yes — a guest’s response, counted as defined in section 5.
  • Your content — everything you and your guests put into Yesroll.

3. Your account

You must be at least 16 years old, or the minimum age of digital consent where you live if that is higher, to hold an account. Give accurate details, keep your sign-in credentials to yourself, and tell us at hello@yesroll.compromptly if you believe someone else has access.

You are responsible for everything done through your account, including by the organisers you add. Adding organisers is free and unlimited; that does not make their actions any less yours.

4. Plans, fees and taxes

Plans, included volumes and rates are those published on thepricing section of our home page at the time you subscribe. Fees are stated in US dollars and are exclusive of any taxes, duties or withholdings, which are your responsibility unless we are required to collect them.

Paid plans renew automatically for the period you selected until cancelled. You can cancel at any time from your account; cancellation stops the next renewal and your plan continues until the end of the period you have already paid for.

We may change our prices. If a change affects a plan you are on, we will give you notice before it applies to you, and the change takes effect at your next renewal — never mid-period. Where we have told you a rate is locked for a stated period, we will honour that period.

5. How the meter works

Yesroll is billed on the volume of responses you collect, never on the number of organisers on your account. One person on one roll is one yes, however many times and in however many ways they respond. Someone who RSVPs, books a slot and answers three questions is a single yes, not five.

Declines, page views, reminder emails, cancelled bookings and edits to an existing answer are never counted. Invitations you send are never counted: we bill on responses received, not on reach.

Where your plan includes an allowance, additional yeses above it are billed in blocks at the published overage rate. You may set a spending cap on your account, and when it is reached we pause collection of new responses rather than charge beyond it. The meter is visible in the product at all times.

If you believe your meter is wrong, tell us within 60 days of the invoice athello@yesroll.com and we will investigate and correct genuine errors.

6. Refunds

Fees already paid are non-refundable except where the law requires otherwise, or where we have failed to supply the service and cannot put it right in a reasonable time. If we terminate your account for a reason other than your breach of these terms, we refund the unused portion of your current period.

7. Your content, and your responsibility for guests

Your content is yours. We claim no ownership of it. You grant us only the licence we need to run the service for you: to host, store, transmit, back up and display your content to the people you have chosen to share it with.

When you collect information about your guests, you decide what to collect and why, and you are responsible for it under the applicable data protection law.We process that information on your instructions, as described in theprivacy notice. You must have a lawful basis for inviting the people you invite, tell them what you are collecting, and honour their requests about their own data. Do not use Yesroll to gather sensitive personal data — health details, government identifiers, financial account numbers — unless you have concluded you may lawfully do so and have told your guests.

You can export your data at any time while your account is active. See section 12 for what happens after it closes.

8. Acceptable use

You agree not to use Yesroll to:

  • send unsolicited bulk messages, or invite people who have not agreed to hear from you;
  • impersonate anyone, or misrepresent who an invitation is from;
  • collect data you have no lawful basis to collect, or that you have been asked to stop collecting;
  • publish unlawful, infringing, deceptive, harassing or malicious material;
  • probe, scan, overload or attempt to gain unauthorised access to the service or its infrastructure;
  • scrape or bulk-collect content except as our robots.txt permits;
  • resell or white-label the service without our written agreement;
  • circumvent the meter, a spending cap, a plan limit or an anti-abuse measure.

Reports of abuse and security issues go tohello@yesroll.com. Please give us a reasonable window to fix a vulnerability before publishing it.

9. Availability and changes to the service

We work to keep Yesroll available and to warn you before anything disruptive, but we do not commit to a specific uptime figure in these terms. Maintenance, third-party failures and events outside our reasonable control can interrupt the service.

We improve and change the service over time. If we remove a feature you materially rely on from a paid plan, we will give you reasonable notice, and you may cancel and receive a refund of the unused portion of your current period.

10. Third-party names and comparisons

The Yesroll name, logo, site design and copy are ours. Evite, Calendly, SignUpGenius and SurveyMonkey are trademarks of their respective owners and appear on this site only to identify and compare products. We are not affiliated with, endorsed by or sponsored by any of them.

Competitor prices shown on this site were the publicly advertised list prices we recorded on the date stated beside them, with sources linked. Third-party pricing changes without notice and varies by region, term and plan. Verify current pricing with the vendor before relying on it.

11. Disclaimers

Other than as expressly stated in these terms, and to the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free. Nothing here excludes rights you have as a consumer that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, punitive or consequential loss, or for loss of profits, revenue, goodwill or data, arising out of or relating to these terms.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these terms is limited to the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

13. Indemnity

You will indemnify us against claims, damages and reasonable costs brought by a third party — including one of your guests — arising from your content, your use of the service in breach of these terms, or your failure to meet your own obligations under section 7.

14. Suspension, termination and what happens to your data

You may close your account at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to act on, or that is being used in a way that endangers the service or other users. Where circumstances allow, we give notice and a chance to put things right first; for serious or unlawful use, suspension may be immediate.

After an account closes we retain your content for 30 days so it can be recovered or exported, then delete it in the ordinary course, subject to the retention periods in theprivacy notice and to any legal obligation to keep records.

15. Changes to these terms

We may update these terms. For material changes affecting account holders we will give notice by email or in the product before they take effect, and the effective date at the top of this page always shows the current version. If you do not accept a change, your remedy is to stop using the service and cancel.

16. General

These terms, together with the privacy notice, are the entire agreement between us on this subject. If any provision is found unenforceable, the rest continues to apply. Our not enforcing a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor in connection with a merger, acquisition or sale of assets. There are no third-party beneficiaries.

17. Governing law and jurisdiction

These terms are governed by the laws of India, without regard to conflict of law rules. The courts of competent jurisdiction in India have exclusive jurisdiction over any dispute arising out of or relating to them, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. Nothing here deprives you of the protection of mandatory consumer law in your country of residence.
